Health & safety at work - employers' duties and responsibilities

Course Overview

Employers have duties to protect their employees and other people from the risk of death, injury and ill health under both the civil law and the criminal law. Despite this, over 2 million people in the UK suffer work-related ill health each year and over 300 die. Millions of working days are also lost, which has a serious impact on profitability.

Keeping up to date on health and safety law and its requirements can help ensure the employer is legally compliant and avoid costly prosecutions by the enforcement authorities for breaches of legislation. This course reviews Employers' duties with respect to the tort of negligence, the Health and Safety at Work etc Act 1974 and more recent legislation, such as the Management of Health and Safety at Work Regulations 1999.

This course will also examine the significance of risk assessment. Under current legislation all employers must undertake 'a suitable and sufficient assessment of the risks' to their own employees and to other persons affected by their activities, and install management systems to either prevent or control exposure to these risks. The criminal and civil liabilities of employers will be examined, including the concept of 'corporate manslaughter', vicarious liability and occupiers' liability, together with the role of the enforcement agencies, the requirements for reporting incidents and procedures for consultation in the workplace.

The course is presented by Jeremy Stranks, who is a Fellow of both the Chartered Institute of Environmental Health and the Institute of Occupational Safety and Health. He is well known as a consultant, author, trainer and expert witness in the areas of health and safety and food safety. He was a founder member of the National Examination Board in Occupational Safety and Health and a chief examiner for many years.
